In the Discovery of Debt Buyers, Brian takes us into a more detailed look at his discovery requests and their impact. You can’t have a “question” without a “quest” and it is all about your goals in making the inquiry or seeking the information from the other side to pin them down to the lack of proof behind their “burden of proof.” When they push back or are non-responsive to your specific request, that is the place you push and then file your Motion to Compel. That puts the issue in front of the Court in your favor and before the inevitable Motion for Summary that you can litigate with your discovery requests before it gets that far. In a sense, discovery could end the inevitability of the Motion for Summary and settle the case. This all starts and ends with your breaking down their complaint and creating your game plan through the Counter Affidavit. Again, what is your “quest” in asking your discovery question.
