Here, Brian finishes up his supplement series on “securitization as a defense” with debt buyer and “fintech” cases. The securitization of debt, while good for the economy, is bad for debt buyers and collectors as with the fintech model of personal loan financing, there are many owners or assignees of the original debt. Mostly weird sounding secured trusts claim ownership but with no proof. Which is a problem for the debt buyer which has to show all assignments or owner Bill of Sales to prove they own the debt they sue you upon. This new pretzel litigation of ownership is another way to show that the company suing you has no standing or the right to sue you. Good viewing and good luck.
