In this video Brian introduces you to a supplement to his other videos on “securitization as a defense” to collection lawsuits. Here, you will see how to handle two types of lawsuits from creditors with securitization as they relate to the ownership of the debt you are being sued on. Generally, the creditor does not own the debt without proof of an assignment from the secured trust back to the original creditor (Creditor suing you) after the default on the creditor obligation. In short, these creditors don’t have standing to sue you without proof they got back whatever they sold to the securitized trust. Good and quick analysis to the previous videos and on a whiteboard for better understanding.
