Here Brian takes a look at a new one, 2023-1 Prime Consumer Loan Trust in another in a series looking at a FinTech loan, debt buyer case with a twist. BUT just treat the Trust collection case like any other debt buyer case and use the documents against them. In this case, the pleadings and supporting documents really sink the Plaintiff who is unnamed in the actual supporting Affidavit and the lawsuit and supporting affidavit swear under oath to things that are not possible.
