Here Brian gives you great tips and a new “Consumer Mini-Miranda” to settle debts with collectors and law firms in response to collection letters or just prior to answering the lawsuit. It is all about taking control of the discussion with the collector and using the “Three Strikes Rule” to keep discussions on the right path or get out of a fruitless conversation with a Headset Harriet. As stated in the video, you don’t have to give them a ton of personal info to get a settlement discussion going. Try to get them to admit they have not validated the debt or don’t have proper proof. Settlement discussions are protected and can’t be used to prove liability against you. The new Consumer Mini-Miranda, however, allows any discussion of ownership into any court proceedings as the Burder of Proof of Ownership by the Plaintiff cannot be waived by the settlement discussions rule.
